This is a personal and professional service provider. You have requested this entity to conduct a service for you. We may provide equipment to be used in connection with our sessions, including but not limited to equipment detailed below.
 
In consideration of the agreement to assist, and support by request, and voluntarily of you own will,  hereby agree to hold this company harmless in any and all events or circumstances including after services rendered.  This company and, its respective representatives, executors, agents, and assignments from any and all claims, demands, damages, rights of action or causes of action, present or future, arising out of or connected to my participation in any and all activities, use of equipment, or any and all acts or omissions, including negligence by this company and or it's representatives. 
 
This waiver and release of liability includes, but is not limited to, (a) injuries and changes to myself and/or others, including but not limited to this company, that may occur as a result of (i) Equipment that may malfunction or break; (ii) any and all defects, latent or apparent, in the design or condition of Equipment; (iii) any and all slips, falls, or dropping of Equipment; (iv) any and all improper maintenance of Equipment or facilities; (v) any hazardous condition that may exist on the premises, including, but not limited to, the specific workout area; and (vi) negligent instruction or supervision; (b) damage to property, including but not limited to, Equipment and the premises. 
 
Text, email, social media and others forms of communication are used regularly during training sessions and each personal service may be recorded for quality and assurance purposes. Your personal information is protected and will not be shared or sold.
 
In consideration of the foregoing premises and for the express contention of carrying out the purposes of a personalized health and fitness services, the parties do hereby agree as follows: Yyou have agreed to participate voluntarily in a program of physical exercise, including, but not limited to, personal services, personal wellness, strength training, flexibility, and aerobic exercise (“Activities”), under the guidance of this company its authorized agents, assignee, employees, and contractors (“Trainer” or Coach). You declare yourself physically and mentally fit to participate and suffering from no condition, impairment, disease, infirmity, or other illness that would prevent participation in any type of session or use of Equipment. You acknowledge this company recommends  a physician’s approval for your participation in an exercise/fitness  or other activity or  use of Equipment. You recognize it is your sole responsibility to obtain an examination by a physician prior to involvement in any  program. You acknowledge you have either been given a physician's  permission to participate, or you have chosen not to obtain a physician’s permission prior to beginning services. You acknowledge you are participating in any program at your own risk. You acknowledge and agree no warranties or representations have been made regarding the results achieved from any program. You understand results are individual and may vary. You acknowledge You have thoroughly read this waiver and release and fully understand it is a waiver and release of liability. By signing this document, you waive any right(s) or my heirs and/or assigns, may have to bring any and all legal actions or assert any and all claims against the company, its respective representatives, executors, and/or assigns. You represent and warrant you are signing this agreement freely and willfully and not under fraud or duress. You further represent and warrant no social relationship exists between any  representative, or if such a  relationship exists, for purposes of  services rendered, representative  and yourself are to assume a strict business relationship, you therefore understand any social relationship does not render this waiver invalid. 
 
These exculpatory clauses are intended to apply to any and all activities occurring during the time for which you have are participating in any services being rendered virtually or in person.
